LUCERNE, Calif. – A man was flown from Lucerne to a regional trauma center Thursday afternoon after he was stabbed.

The incident occurred in the 6000 block of Highway 20 near the Foster's Freeze restaurant, according to radio reports.

Northshore Fire personnel arriving at restaurant found a male victim, with the suspect said to be across the street at the location of the fight, reports from the scene stated.

Firefighters moved the patient to the area of Seventh Avenue and Highway 20 as they waited for sheriff's deputies to arrive, based on scanner reports.

A REACH air ambulance was requested, with the helicopter landing shortly before 5 p.m. at a landing zone set up at Lucerne Harbor Park.

The air ambulance lifted off for Santa Rosa Memorial Hospital just after 5 p.m., according to radio reports.

Several sheriff's deputies and a California Highway Patrol officer were at the scene interviewing witnesses.

A bystander reported witnessing one young male suspect being taken into custody.

The U.S. Environmental Protection Agency has accepted the California Department of Public Health Drinking Water Program’s (CDPH DWP) corrective action plan in response to the April 2013 notice of non-compliance with the Safe Drinking Water Act.

On Wednesday, California Department of Public Health Director and State Public Health Officer Dr. Ron Chapman said his agency was committed to meeting federal and state goals to ensure Californians have access to safe and reliable drinking water throughout the state.

“We are pleased the U.S. EPA today accepted our corrective action plan, which allows us to achieve this goal through funding small, medium and large water system projects across the state,” he said. “We have improved our processes and work with stakeholders over the last two years and will make continued improvements to get funding to water projects more quickly.”

Chapman said CDPH will continue to work closely with its federal and state partners, and all interested parties toward achieving the goal of providing safe drinking water through California’s public water systems.

In April, the US EPA informed CDPH that it was not in compliance with the Safe Drinking Water Act reporting that $455 million out of the $1.5 billion has been provided to California to capitalize the Safe Drinking Water State Revolving Fund had not been spent, as Lake County News has reported.

Last month, CDPH submitted a corrective action plan to the US EPA that addressed all 29 of the issues raised by the federal agency in April, with $84 million intended for immediate distribution for water projects across the state.

In addition, CDPH had anticipated it would distribute nearly $200 million in total funds in this new fiscal year and in the two upcoming fiscal years, and will disburse an additional $600 million for water projects.

CDPH documents had listed $1.8 million for surface water treatment plant improvements for the community of Spring Valley east of Clearlake Oaks among its current list of executed funding agreements for water projects.

NORTH COAST, Calif. – Thanks to aggressive efforts by firefighters on the ground and in the air, a wildland fire near Hopland was contained within hours on Tuesday afternoon.

The Pratt Fire, located at Highway 175 and Pratt Ranch Road in Mendocino County, was first reported at about 1:30 p.m., according to Cal Fire.

Cal Fire said a total of 45 acres burned, with the fire fully contained at 4 p.m.

The fire had burned close to the highway and structures, with additional agencies called in for mutual aid, according to radio reports. From above, Cal Fire air resources hit the fire quickly.

There was aggressive spotting on the incident, with three spots on the south side of Highway 175 at one point, radio reports indicated.

COBB, Calif. – A 3.0-earthquake was reported Thursday afternoon near The Geysers geothermal steamfield.

The quake occurred at 3:36 p.m. and was centered three miles northwest of The Geysers and 13 miles southwest of Clearlake at a depth of six-tenths of a mile, according to the US Geological Survey's preliminary report.

As of 4 p.m. the survey had not received any shake reports.

A 3.1-magnitude quake was reported on Cobb last Thursday, as Lake County News has reported.

MIDDLETOWN, Calif. – The Sheriff’s Narcotics Task Force eradicated 6,206 marijuana plants from two separate locations in the Middletown area on Monday.

No suspects or evidence leading to the identity of the growers were located at the grows, according to sheriff's spokesman Lt. Steve Brooks.

In April, narcotics detectives conducted overflight missions in the Middletown area in an effort to locate illicit marijuana growing operations, Brooks said.

He said during the overflight detectives located what appeared to be two illicit growing operations.

One of the grows was located in an area commonly known as Dog Rock, which is located off of Dry Creek Road in Middletown, Brooks said, with the second located in an area commonly known as Black Oak, located off of Butts Canyon Road in Middletown.

At 8 a.m. Monday narcotics detectives entered the grow site in the Dog Rock area. They located and eradicated 2,222 marijuana plants in different stages of maturity, Brooks said.

On the same day at 11 a.m. narcotics detectives entered the grow site in the Black Oak area, where they located and eradicated 3,984 marijuana plants, also at different growth stages, he said.

Brooks said that, so far this year, the Sheriff’s Narcotics Task Force Marijuana Unit has eradicated 128,349 marijuana plants from Lake County this year.

In addition, they have seized 421 pounds of processed marijuana, 76 firearms, made 42 arrests and seized $51,596 for asset forfeiture.

NORTH COAST, Calif. – Local and state firefighters are working on a wildland fire off of Highway 175 in the Hopland area.

The fire, located off of Highway 175 at Pratt Ranch Road, is east of Hopland, according to Cal Fire spokesperson Julie Cooley.

Cooley said the fire was first reported at about 1:30 p.m. Tuesday.

Shortly before 2:30 p.m. it had reached an estimated 30 acres, Cooley said.

“It's got aggressive spotting ahead of the main fire,” she said.

Structures are threatened but Cooley did not have information immediately available concerning how many were in the fire's path, or whether they were homes or outbuildings.

Reports the California Highway Patrol received on the fire indicated there were some homes nearby.

Cal Fire air resources have been hitting the fire from the air, and mutual aid is being requested from nearby agencies.

Although the fire was reported to be burning close to the roadway, no road closures had been reported as of 2:30 p.m.

Fire official estimated around 3:30 p.m. that the fire had reached close to 50 acres.

LAKE COUNTY, Calif. – Clear Lake High School cyclist Nathan Barnett scored a top 10 finish at his first-ever national level cross country mountain bike race.

This year, the Cross-Country Mountain Bike Nationals headed to the East Coast for the first time since 2008.

With local sponsorship support from Jeff and Tami Cramer at Main Street Bicycles, Barnett – a junior at Clear Lake High School who finished fourth overall in the California State High School Mountain Bike championships earlier this year – made the trip to the Bear Creek Resort in Macungie, Penn., last week.

More than 1,000 riders of all ages took to the trails at Bear Creek Resort in eastern Pennsylvania Thursday, July 18, through Sunday, July 21, vying for coveted stars-and-stripes jerseys in cross-country, short track cross-country and Super D race classes.

After practicing the grueling 3.6-mile mountainous single track race course for two days, the 16-year-old Barnett put his skills and fitness to the ultimate test for the “Category 1” or “Expert” level cyclist on Friday, July 19.

On that morning Barnett took the start flag along with 29 other aspiring professional cyclists and charged into the mountains for what would turn out to be a grueling one-hour, four-minute sprint through the winding, wooded, rocky single track course.

Despite falling during his aggressive pursuit of another rider, Barnett was able to remount his carbon fiber Specialized Epic race bike and continue on to an impressive 10th place finish.

“These kids were quite a bit faster than the Nor Cal Mountain Bike league racers, but I felt like I had the speed and confidence in my equipment to put in a good ride,” Barnett said following the race.

Barnett said next he'll be racing the Downieville Classic in two weeks. He won the beginner 15-18 year old class last year and will be racing the Expert 15-18 class this year.

“After Downieville I'll begin moving some of my focus to road racing and time trialing,” he said. “I would really love to ride the AMGEN Tour of California someday on a pro cycling team.”

Barnett thanked the Cramers for their support of his racing. “They have been a huge help and I really appreciate it.”

KELSEYVILLE, Calif. – County and state officials are taking action against a Kelseyville mobile home park where a sewage spill took place earlier this month.

The spill occurred at Kolaia Landing, located at 8910 Soda Bay Road.

On Saturday, July 13, the wheels of a boat trailer ran over a sewage effluent pipe at the 12-space park, crushing the pipe and leading to the spill, according to Lake County Environmental Health Director Ray Ruminski.

Ruminski said he received a call from Lake County Central Dispatch at 6:30 p.m. the day after the spill, and went out to check things over that night and talked to a resident.

He said the park is served by two separate septic tanks and leach fields, which Ruminski added is “fairly typical” in older mobile home parks like Kolaia Landing.

The pipe that was broken transported effluent up to a leach field at a higher elevation. A pressurized part of the pipe is above the ground and next to a driveway, said Ruminski. That's the area that was damaged by the boat trailer.

Instead of having the repairs made immediately, the park's management waited until Monday, July 15, Ruminski said.

Ruminski went out again that same Monday to find the pipe had been repaired. However, he said, “To us, the repair is not adequate.”

He said the pipe remains above the ground – a violation of county code – which means it can be crushed again at any time.

Effluent from the septic tank also remained on the ground at that time. While not raw sewage, Ruminski said effluent is just as much of a health hazard.

“For us, the risk, the hazard, the nuisance, the risk of disease – it's sewage,” he said.

The other issue, said Ruminski, is conducting repairs without the proper county permits.

Ruminski said he has not been able to speak to the owner, Susan Frances – reported to be out of the country – or to her manager, David Brown, which Ruminski said is a frustration in the effort to resolve the matter.

When Ruminski knocked on the door of the manager's residence no one answered, he said.

The park's listed phone number also has been disconnected and Brown did not return a message seeking comment from Lake County News.

When it comes to handling mobile home parks, Ruminski said the county works with the California Department of Housing and Community Development, which has jurisdiction over such parks.

However, he said the county can still use its local codes and authorities to pursue action against Kolaia Landing.

Eric Johnson, California Housing and Community Development spokesman, said the agency sent out an inspector on Tuesday, July 16.

The state’s inspector made three findings identical to those made by Lake County Environmental Health – sewage discharge on the ground, sewage pipe repaired without a permit and a pipe that's carrying sewage being exposed to damage or, in other words, being above ground when it's supposed to be buried, Johnson said.

Johnson said they were assured by the park's manager that he's cleaned and sanitized the area, but the inspector found there was still sewage exposed.

However, a park resident told Lake County News that the manager's idea of sanitizing was dumping bleach on the affected area. Ruminski said a water hose was running into it to dilute it.

The park has 30 days to comply from the July 16 inspection date, Johnson said. “If all goes according to plan, it will be fixed very soon.”

An inspector will return to the park to make sure the effluent is cleaned up and the pipe is properly buried, said Johnson, adding there will not be penalties if those corrections are made.

Other than this most recent issue, “We have no complaints in our records about this particular mobile home park,” Johnson said.

Ruminski, who is serving the park with a notice of violation, said there could be monetary penalties and fees – including charging the park for his staff's response time – if the park fails to correct the problems. Those penalties don't require a court decision, he added.

“The residents really shouldn't have to mess with that and be exposed to that hazard and that nuisance,” Ruminski said.

There also is the possibility of infractions or misdemeanor charges for failure to comply. “I'm going to explore that,” Ruminski said.

Ruminski expects the case could become very time consuming for his department if it goes to court.

He added, “We don’t not do something because it’s extra work.”

NORTHERN CALIFORNIA – On Tuesday, Lake County's members of Congress and a Napa County rancher testified before a House subcommittee regarding legislation to establish a National Conservation Area across the region stretching from Snow Mountain to Lake Berryessa.

Congressman John Garamendi (CA-3) and Mike Thompson (CA-5) testified at a Committee on Natural Resources’ Subcommittee on Public Lands and Environmental Regulation in support of H.R. 1025, the Berryessa Snow Mountain National Conservation Area Act.

Judy Ahmann, a private land owner and rancher from Napa, also testified in support of the legislation.

H.R. 1025, introduced by Thompson in March 2013, would designate the 350,000 acre Berryessa Snow Mountain region as a National Conservation Area (NCA).

Under this designation, all currently owned federal lands within the NCA boundary would be united under one management plan, allowing the region to be managed according to the site-specific needs.

The region also would be permanently protected under a NCA designation, ensuring continued recreational opportunities while safeguarding the region’s natural beauty, wildlife, rare plants, and waters – which include important sources of drinking water and irrigation for nearby communities.

“The Berryessa Snow Mountain Region is a national treasure,” Thompson said during testimony. “We have a responsibility to preserve it and make sure the region is managed efficiently and responsibly. Designating the region as a National Conservation Area would preserve the land, help our local economies, and benefit those who live in and visit the Berryessa Snow Mountain Region.”

Garamendi, former Deputy Secretary of the Interior, told the subcommittee, “The Berryessa Snow Mountain NCA bill would open up a range of business opportunities for our region. The bill allows for federal agencies to coordinate on management of federal lands.”

He said the NCA designation has a proven track record of increasing tourism and creating jobs, which is why H.R. 1025 has garnered the support of chambers of commerce, boards of supervisors, Northern California cities and other local stakeholders.

Ahmann and her husband operate a 3,000 acre cattle ranch, Running Deer Ranch, directly adjacent to Bureau of Land Management lands that are included in the proposed National Conservation Area.

“As a grandmother, protecting our public lands for future generations is important to me,” she said. “I want to make sure that this scenic treasure is permanently protected so that it can be enjoyed by my grandchildren and their grandchildren.”

“I am overjoyed that this legislation is gaining momentum,” said Sara Husby-Good, executive director and campaign director of nonprofit Tuleyome. “There are many people who enjoy recreating in the Berryessa Snow Mountain Region because there is something for everyone. Visitors can hike, hunt, camp, fish, bird, mountain bike, use off road vehicles on legal routes, boat on Lake Berryessa, horseback ride and much more. I look forward to a House floor vote for this important legislation.”

Proposed Berryessa Snow Mountain National Conservation Area

LAKE COUNTY, Calif. – Following a federal investigation that began in late 2012, on Monday federal charges were filed against two Lake County men for conspiracy to manufacture and distribute more than 1,000 plants of marijuana and using a 15-year-old girl in a drug operation, with allegations the men locked the girl in a metal box for several days.

Ryan Alan Balletto, 30, of Lakeport, and Patrick Steven Pearmain, 25, of Clearlake, are charged in a criminal complaint signed by Magistrate Judge Nandor J. Vadas and unsealed on Monday, according to US Attorney Melinda Haag's office.

Haag's said the Lake County Sheriff’s Office and the Immigration and Customs Enforcement Homeland Security Investigations, Contraband Smuggling Group, worked together on the case, leading to the discovery of a 1,300-plant marijuana cultivation operation and a host of firearms in Lake County.

Balletto and Pearmain made their initial appearance on the charges on Monday in front of Judge Vadas. A detention hearing is set for both defendants on Wednesday, July 24, at 1 p.m. In Eureka.

The complaint alleges that Balletto and Pearmain kept a 15-year-old runaway girl for weeks at an extensive marijuana grow site on 681 acres of land owned by Balletto in Lake County, and that they used her to process marijuana plants.

According to the complaint, Balletto and Pearmain allegedly subjected the teenager to sexual abuse during the time they held her, with the investigation revealing items used for sexual bondage and a metal toolbox that the girl told investigators she was kept in on two separate occasions.

In addition to the conspiracy and use of a minor charges, Balletto also is charged in the complaint with possession of a firearm in furtherance of a drug trafficking crime.

“Some in our community believe that marijuana grow operations are run by compassionate caregivers interested only in supplying medicine to the sick. Unfortunately, this case illustrates what we in law enforcement see – marijuana grow operations that include heavily-armed, violent individuals, motivated by profit, carrying out abuses of vulnerable victims,” said Haag.

The men – arrested this spring – previously had been facing drug and human trafficking charges in Lake County, but those cases were dismissed last Friday in preparation for the federal charges, as Lake County News has reported.

Lake County District Attorney Don Anderson said last week his office will continue its investigation into the human trafficking allegations relating to the minor girl in order to potentially file charges in the future.

He said his office has been working with the US Attorney's Office on the case, which he said originated with federal investigators.

A lengthy investigation

The Department of Homeland Security's Immigration and Customs Enforcement agency began investigating Balletto in December 2011 on suspicion of drug trafficking, according to case documents.

In August 2012, the Homeland Security Investigations Asset Identification and Removal Group identified six parcels of land Balletto had purchased in April 2011 and a parcel purchased in July 2010, with several of those pieces of land located in the Ogulin Canyon Road area, the documents state.

This past April 12, Lake County Sheriff's Det. Frank Walsh conducted a flyover of the properties and identified two greenhouses, with Walsh and a federal special agent preparing warrants to be served in May, according to the complaint.

On April 29, the Los Angeles Police Department requested the sheriff's office's help in the search for the missing girl, who they believed had been kidnapped by Balletto and transported to Lake County, where she was being held against her will on Balletto's property.

That same day, officials went to Balletto's home address in Lakeport and spoke with his girlfriend, Christa McConnell, asking her about the girl and Balletto. Court documents said she was reported to be uncooperative and said Balletto had not been home for days.

The following day, April 30, the 15-year-old girl placed two cell phone calls to the Lake County Sheriff's Central Dispatch, telling them she was “OK” and with someone named “Ryan” in Sacramento. Officials said detectives were able to track the calls, finding the girl in a West Sacramento hotel and taking her into protective custody that same night.

At that time they also arrested Pearmain, who had marijuana and prescription drugs in his possession. In the hotel room, federal officials said they found condoms and a pregnancy test.

During the service of search warrants at Balletto's property on May 1, the complaint said agents and officers allegedly discovered a cache of weapons at the grow site, most of which were loaded, including assault weapons, such as AR-15 style rifles with night vision scopes, and pistols.

Stored with the rifles, officers allegedly found seven fully loaded 30-round .223 caliber magazines, four fully loaded 20-round .223 caliber magazines, and a large cache of assorted ammunition, officials reported.

With the weapons, Haag's office said officers allegedly found ballistic face masks, a helmet, a flak jacket, an armored plate carrier, night vision devices and a gas mask.

A search of Balletto’s Lakeport residence allegedly uncovered even more weapons, including multiple sniper rifles, additional assault rifles, shotguns, pistols and ammunition, according to Haag.

Signs of bondage, abuse

In addition to marijuana and the weapons cache, the search of Balletto's property in Ogulin Canyon revealed “equipment consistent with sexual bondage and sadomasochism,” the criminal complaint stated. Among the items found were a homemade rack and a white towel with stains which tested positive for human blood, as well as metal and leather harness.

Investigators also found a metal tool box – measuring 4 feet long by 2 feet wide by 2 feet deep – that the complaint said “had been altered to imprison a human,” with air holes drilled into the lid and a blanket inside.

Anderson had told Lake County News in a previous interview that it's believed the men kept the 15-year-old girl in the box as punishment.

During subsequent interviews with investigators, the minor girl told them that she had been trimming marijuana for the men and that she had been kept in the toolbox on two different occasions for a total of three days. Balletto reportedly told her she was a “trooper” for not screaming while being held in the box.

The complaint said investigators found a poem by the girl in Balletto's trailer on the property describing being locked inside a box with holes in it.

She related to investigators that the marijuana grow was a “mission” and that Balletto and Pearmain locked her in the box to protect that mission and to teach her because “they had to prove a point.”

The girl said she had consensual sex with Pearmain but the sex with Balletto was not consensual and was “to help him out.” The complaint noted that, at age 15, she is not legally able to give consent to have sex with an adult.

There are concerns that the potential for more victims exists, according to Haag.

“In light of the details alleged in the complaint, we fear additional victims may have been subjected to similar treatment by the defendants, and we urge anyone with information about other such victims to come forward,” Haag said.

Haag's office said the penalties Balletto and Pearmain face for the drug conspiracy and use of a minor in a drug operation charges are a maximum of life in prison, with a mandatory minimum 10-year term, officials said.

In addition, the possession of a firearm in furtherance of a drug trafficking crime carries a mandatory term of five years in prison, consecutive to any sentence imposed, according to federal prosecutors.
