General plan, Affinito abatement on Tuesday board agenda

LAKEPORT – On Tuesday the Board of Supervisors will meet both at its regular time in the morning to consider an abatement proceeding against a developer and in a night session to consider approving the county's new general plan.


The board's morning session will begin at 9 a.m., while the evening session will start at 6 p.m. Both will be held in the board chambers at the Lake County Courthouse, 255 N. Forbes St., Lakeport. The morning session will be telecast live on TV Channel 8.


The county's general plan update has been in the works for several years, with several new elements included, such as one specifically to address maintaining the county's agriculture. It also will update zoning in various areas of the county.


The document, which can be found at the county's Web site, www.co.lake.ca.us, sets out a 20-year development plan for the county's unincorporated areas.


The 6 p.m. session will be a public hearing to take comment on the document, which already has received approval by the Lake County Planning Commission.


During the board's morning meeting, supervisors will consider a recommendation from Community Development Director Rick Coel and Code Enforcement Manager Voris Brumfield to abate a property located at 6965 Hammond Ave. in Nice, which is owned by Sacramento developer Dominic Affinito.


Affinito has proposed to build a large development – including 57 single-family homes, duplexes and triplexes and senior housing – on the site and an adjacent parcel, which together equal about 17 acres.


However, last October, the board turned down a two-year time extension on Affinito's tentative subdivision map. That decision was based, at least in part, on the fact that he had not completed work, including the installation of a retaining wall and other erosion control measures, to fix a 9-foot cut that resulted from grading on the site, as Lake County News has reported. Affinito also had imported 4,000 cubic yards of fill.


Coel's report to the board for Tuesday noted that although Affinitio provided temporary erosion control at the site following the October 2007 meeting, he has yet to construct the retaining wall or finalize his grading permit.


A certified letter was sent to Affinito on the matter in June, but he still has not complied, Coel reported. The report packet contains no response letters from Affinito.


Coel is suggesting the board abate the property's issues which, if Affinito doesn't act, could result in the expenses to do the work being charged against his property.


Affinito also owns two properties on the lakeshore in Lucerne – the Lake Sands Resort, at 6335 E. Highway 20, and the Lucerne Motel, 6339 E. Highway 20 – that the county voted to abate in June of 2007.


At the board's June 19, 2007, meeting, they gave Affinito 30 days to evict his tenants – he was renting rooms in the motels on a long-term basis – and comply with a nuisance abatement order.


Code Enforcement's case against Affinito was opened in 2004, county officials reported at that time.


Supervisor Denise Rushing told Affinito at that meeting that the community of Lucerne was asking him to correct the blight in the form of the motels.


Today, however, the two buildings remain in much the same shape, although the tenants have left and the Lake Sands is now boarded up.


In other items on the short agenda, the board will consider a contract between the county and Lake Family Resource Center for CalWORKs behavioral health services.


During the morning meeting, the board also will hold a closed session for labor negotiations with county employee groups and the In-Home Supportive Services union.
