Directive restricting access to specified areas of the city of Clearlake as a result of the Cache fire

DIRECTIVE BY THE CITY OF CLEARLAKE DIRECTOR OF EMERGENCY
SERVICES RESTRICTING ACCESS TO SPECIFIED AREAS AS A RESULT OF
THE CACHE FIRE (DIRECTIVE #CACHE-01)


WHEREAS, on August 18, 2021, the Director of Emergency Services (City Manager) for the City of Clearlake issued a Proclamation of Local Emergency due to the Cache Fire, which was ratified by the City Council on August 19, 2021; and

WHEREAS, the Director of Emergency Services (City Manager) is empowered to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency; and

WHEREAS, widespread evacuation orders are being lifted due to the extinguishment of the Cache Fire, however, there remain areas of damage that contain significant debris, including potentially hazardous waste, and these areas are also susceptible to criminal activity and theft, and it is thus in the interests of public health and safety to restrict access.

NOW, THEREFORE, IT IS PROCLAIMED AND ORDERED by the City Manager of the City of Clearlake:

1. No person shall enter or remain upon any parcel within the following areas except the parcel owner, owner’s agent, lawful resident, or person authorized by the parcel owner, owner’s agent or the lawful resident.

a. The parcels and areas south of Dam Road to Cache Creek, from the parcel known as 16335 Dam Road to the west and the western border of the parcel known as 16535 Dam Road to the east (Cache Creek Mobile Home Estates).

b. The area bounded by the PG&E transmission line right of way to west, 6th Avenue to the North, Cache Street to the east (prolongated to Dam Rd) and to the north roadway edge of Dam Road.

c. The areas are further described in the attached map, Exhibit A, incorporated herein by reference.

2. The following street segments are closed. No person shall enter or remain on these closed streets nor shall any person operate a vehicle or park a vehicle on the streets.

a. 8th Avenue between Boyles Avenue and Wilkinson Avenue

b. Wilkinson Avenue between 3rd Avenue and 8th Avenue

c. 6th Avenue between Konocti Avenue and Cache Street

d. 5th Avenue between Konocti Avenue and East Drive

e. 4th Avenue between Konocti Avenue and East Drive

f. 3rd Avenue between Wilkinson Avenue and East Drive

g. 2nd Avenue between Wilkinson Avenue and East Drive

h. Cache Street between 6th Avenue and 2nd Avenue

i. Old Dam Rd/2nd Avenue (northeast segment) between Dam Rd and 2nd Avenue.

j. Unnamed road segments between 6th, 5th, 4th, 3rd and 2nd, between Wilkinson and Cache Street.

k. The areas are further described in the attached map, Exhibit A, incorporated herein by reference.

3. This order shall not apply to peace officers, fire and rescue personnel or other government officials, or persons acting at their direction, nor to any electrical, sewage or utility workers, insurance company representatives or contractors thereof, or other workers when acting in the course and scope of their employment.

4. Nothing in this order shall apply to duly authorized representative of any news service, newspaper, or radio or television station or network when acting in the course and scope of their employment.

5. Notice of the closure shall be posted at appropriate locations during the period of closure, if feasible. However, failure to post such notices shall not invalidate such closure nor shall it invalidate any exclusion for violating this order.
