DEA conducts Upper Lake raids, make arrests PDF Print E-mail

UPPER LAKE – Federal authorities arrested a well-known Upper Lake contractor Tuesday as part of an extensive enforcement operation, with at least two others also taken into custody.


But the federal defenders assigned to Upper Lake resident Tom Carter's case said in court documents filed this week that the complaint against him is “sadly deficient” and offers little in the way of information about his alleged involvement in a May marijuana deal arranged by an informant.


Dozens of Drug Enforcement Administration (DEA) agents armed with assault rifles and driving more than two dozen black Cadillac Escalades descended on the Hunter Point Road home Carter shares with wife, Jamie Ceridono, on Tuesday just before 7:30 a.m., Ceridono said Friday.


Ceridono said she counted four helicopters flying overhead at one point during the operation.


Later that day, Brett Bassignani, Carter's co-defendant in the case, was arrested at his Clover Valley Road home, Ceridono said. Also arrested was a neighbor, Scott Feil.


“I don't know the charges,” said Ceridono. “I don't know what's going on. No one has told me.”


Ceridono said her husband is being held at a jail facility in the Oakland area. Initially, after the arrest, she said he was taken to Sonoma County and was checked by medical personnel after his blood pressure shot up, causing her to believe he was having a heart attack.


“I don't know what he could have done to cause this,” she said, noting that her husband has worked hard all of his life, donated time to community causes and done fundraisers, as well as introducing the recent Rainbow Bridge Festival.


She said she saw a sheriff's official and another man who she believed was a local policeman on scene. Capt. James Bauman of the Lake County Sheriff's Office said the agency wasn't involved in the DEA operation earlier this week.

 

DEA spokesperson Casey McEnry would offer little information about the raid.


“I can confirm the enforcement operation; however, the search warrants remain under court seal and I am prohibited from providing further details relating to the operation. I don't anticipate the warrants being unsealed anytime soon,” McEnry said in an e-mail response to Lake County News' inquiry about Carter's arrest.


When pressed on the circumstances of Carter's arrest, McEnry referred Lake County News to the US Attorney's Office in San Francisco. Repeated attempts to contact a spokesperson at that agency Friday afternoon were unsuccessful.


Carter, who was arraigned Wednesday, is facing two felony counts of conspiracy and possession with the intent to distribute under the federal Controlled Substance Act.


At his hearing, the US Attorney's Office requested that he be detained “on the basis of flight risk and danger to the community,” according to federal court documents obtained by Lake County News.


A detention hearing is set for Wednesday, Aug. 26, in San Francisco before US Magistrate Judge Bernard Zimmerman.


Ceridono said she was held in a chair in her front yard from about 7:30 a.m. to 3 p.m. on Tuesday. Also held were members of her husband's construction crew. Her teenage daughter was allowed to leave with her older daughter during the operation.


Officials took 154 marijuana plants that Ceridono said were covered by medical marijuana prescriptions held by her husband and several others. Also taken was her computer.


Agents went through Carter's and Ceridono's home, but she said they didn't trash it. She said a head agent seemed surprised not to find more plants or evidence.


Ceridono said at one point agents “didn't have anything to do.”


“They were playing with my dogs, they were so bored,” she said.


She said her husband, whose hard physical labor has resulted in a lot of aches and pains, also suffered a fracture in his back in May when he rolled his truck, and uses medical marijuana to deal with pain. Ceridono said she doesn't use the drug.


Federal court documents show that the US Attorney's Office requested on Aug. 14 – four days before Carter's arrest – that documents filed against him in the United States District Court for the Northern District of California be sealed, which US Magistrate Judge Maria-Elena James agreed to do the same day.


On Wednesday, US Magistrate Judge Bernard Zimmerman signed an order to unseal the documents at the request of Assistant US Attorney Tarek Helou.


On Thursday, federal defenders Barry J. Portman and Geoffrey A. Hansen filed a 26-page pre-trial memorandum regarding Carter's detention to dismiss the case, citing “sadly deficient” evidence.


The document explains that a confidential informant claimed to have arranged to purchase marijuana from Carter, leaving a message on an unspecified number alleged to be Carter's voice mail to set up the deal. That same informant allegedly made a purchase deal with Bassignani.


Carter's federal defenders said the case against Carter contains no claim that he got the phone message the number that the informant allegedly called and its relationship to Carter also isn't set out in the complaint against him, they noted. Feil''s arrest wasn't listed in the documents.


“All the complaint says is that another individual, Mr. Bassignani, called the informant, claimed he worked for 'Carter Construction,' and arranged a marijuana deal,” Carter's defense attorneys state.


The document continues, “The deal later took place, and the only other reference to Mr. Carter is the conclusory claim that the informant 'had agreed on the price with Carter.' No context, no specifics, and no other information is provided in the complaint which indicates that Mr. Carter in fact talked to the informant, arranged a marijuana deal, and indicated that he (Carter) was knowingly involved in a marijuana transaction.”


The attorneys added, “This complaint is sadly deficient with regard to whether Mr. Carter has done anything to indicate that he conspired to break the law. It should be dismissed accordingly.”


Carter's counsel also is seeking to receive copies of any evidence that may have been collected by wiretap.


Ceridono said she and a group of friends and supporters are planning to travel to San Francisco next Wednesday for her husband's hearing in federal court.


In the wake of the raid, Ceridono said she feels like she's living in another country. “I don't feel like I'm in California at all.”

First we get shat upon by the local authorities, now we have jack-booted Feds coming after us. Maybe that Liberty tree does need a little watering. I don't know who left Capt. James Bauman out of the loop, but when I drove by the Upper Lake Forestry Station at approx. 8 a.m., on Tues., there were two Sheriff's cars parked on Elk Mt. Rd., and numerous other vehicles which I believe where involved in the raid. Is this another attempt by our SO to be less than honest? Or just their standard MO of smoke and mirrors???smilies/shocked.gif
If in fact, the location of these vehicles is strictly by coincidence, isn't this the second operation conducted by the Feds in UL that our local authorities have been left out of the loop. Do you suppose the Feds don't have alot of faith in the our SO either?

these folks tried, convicted and sentenced. Don't need no stinkin trial, don't need no stinkin' evidence. The authorities say it's so, so it must be true. As to the amount of plants - they are called co-operatives and are actually something the county is trying to implement.

You know the tale guest, first they came for one neighbor and I said nothing, then they came for more neighbors and I said nothing. When they came for me - there was no one left to say anything.

be doing what your neihbors are doing. Donna, You are already letting this guy off without knowing the charges. How is that different. I know, it has to do with pot so obviously he has done nothing wrong. There are people who are supplementing their income by selling drugs. Some are even good people. Those of you who need medical marijuana should be angry at this guy for putting another black mark on your cause. Of course, thats not the real goal is it.

Sometimes I think I have nothing to fear except my own government. This IS the reality of California. We have been infected by a bit of the virus that struck Nazi Germany. These viruses ("meme's" if you will) are more virulent than biological or computer viruses.
My heart goes out to Tom, Jamie, Scott and all their associates, who have been horribly traumatized by "law enforcement". In 20 years all this will be legal, and the actions of the DEA will be seen to be barbaric (as if that weren't already apparent!).

When a couple was arrested on a suspected pot and weapons investigation in Upper Lake on May 14, 2009, the news about these arrests were posted the very next day in the local newspapers. Why the delay on publishing information on this raid and arrests? If the arrests took place on Tuesday Aug. 18th why is it just now being published locally? Any thoughts or comments?

The May story getsoulful is referring to came off of a press release from Mendocino County. Most of the locally conducted enforcement operations are reported on fairly quickly.

In this case, the feds didn't appear to want this information out there, so it was a few days before I was able to chase down this case, which was at first sealed in court documents. There was no intent to report it differently -- as soon as we can get accurate information we go with it.

Whether I agree with this bust or not - I am sitting here scratching my head and keep wondering what the heck these guys were thinking.?. I've never smoked pot but 154 or so plants might be asking for trouble when a man not far up the lane was just sentenced to ten years I believe it was. That's an amazing amount of man power and vehicles for what is reportedly such a small growing operation too - not buying that.

To paraphrase Winston Churchill or was it Roosevelt, we have nothing to fear except our own government. They are against us. We are the little people, the minions without power, and our rights are certainly diminishing.

It seems the DEA and other Federal agencies have tainted our local law enforcement by giving them huge sums of money to go after our own citizens who are abiding local laws.

It is a joke for "Law Enforcement Officers" to throw a man in jail for ten years for growing medical marijuana. You can hear them laughing all around the county! Everyone involved probably got a bonus, raise or promotion for these persecutions... of which there are far too many!

Did you all think they would stop after they got Eddy? They want more. They get paid lots of money to do this!

Obama never promised to legalize pot. Get over it and elect someone who will legalize it. Use the power of your vote and your voice to change this sorry state of affairs.

Right on Chris. This is great fun for these G men. They pick their targets carefully, to minimize risking their own ass, both physically AND politically. If you are not connected to the higher power structure, or a bunch of thugs with Uzi's, you need to walk a straight path in this state. In most counties I've lived in, at any rate. I don't think they could get away with this in the Bay area, but then, it is not likely they are growing their own weed. They let the rural denizens take that risk, so they can enjoy the smoke of their choice.

This is just more evidence of how the DEA is becoming America's SS storm troopers. They will raid anyone based upon whatever flimsy evidence some PAID informant gives them. Like the fact that they are paid isn't going to lead them to hype up what is really going on - just people taking care of their own medical needs. Big Pharma and the Health Insurance industry are indirectly behind these raids by their continued lobbying to keep marijuana illegal. This is why we MUST make it legal, so the law has NO REASON at all to make criminals out of us.

Speaking of laws, as Lake County attempts to create its own medical marijuana laws based upon Prop 215 & SB420, no one has mentioned the UNSEEN hand of the FEDS guiding certain elected officials. I think it's time for our Supervisors and Sheriff to come clean about what influence the DEA is having upon our democratic process.

With all this Federal Drug War money flowing into local law enforcement coffers, we must pause and consider how that money is not only corrupting our County employees, but how the DEA is leaning on our Supervisors and Sheriff to make our medical marijuana law more to their liking. It is one plausible explanation for why each time the Planning/Community development department comes up with a potential ordinance, suddenly there are NEW RESTRICTIONS that weren't discussed before in public. Restrictions that make no sense.

Rather than helping our citizens obtain safe access to their medicine, we are seeing laws being considered that deny our citizens the right to grow their own medicine on their own small plots of land. Laws that allow the police to confiscate our land & property if every rule isn't met. It's time to stop encouraging our local law enforcement to find flimsy reasons to lock us up so they can steal our property. It's time to stop taking Federal money to bust local collectives who are abiding by the law.

If the next supervisor meeting doesn't address these issues, and the next proposed law continues to find more ways to criminalize medical marijuana users and collectives, it will be time to confront our elected officials in public. Demand that they explain themselves and these proposed laws that never find their way into public debate, but get inserted into our proposed marijuana laws via a backroom deal with the Feds. We must have transparency in this process. We must know who is kowtowing to the DEA and what influence they are having over our elected officials. Then we will know who needs to recuse themselves from this issue due to conflict of interest, and who we need to vote out of office next election...

STOP TAKING DRUG WAR MONEY! The FEDS should only be busting grows on FEDERAL LAND, not private land! Which of our elected officials will stand up to the FEDS and refuse to take their DRUG WAR money until they stop persecuting medical patients and their caregivers?

Lets see if I get this right. The Drug Enforcement Agency is spending money trying to enforce unlawful drug activity. They are giving money to local agencies to help them and thats what makes them bad? How dare they target those who abuse their priveledges by growing more than they are supposed to and selling to the youth of our country. How dare they look after the interests of those who follow the laws that are in place.

How about stopping the lies about this being about medicine. Or even freedom for that matter. This is just as much about money as it is about freedom. These coops are meant to share not to sell. You haven't figured it out yet have you - the idea is to intentionally dumb down America. You can't argue that it isn't working, the transfer of wealth upwards in this nation is staggering. You have this man already convicted. Do you work in the DA's office? The education system in California is pitiful - if you rely on the 'gubmint' to make sure your kid is educated you're letting your kid down. You're trying to make these issues an either/or situation and that isn't supported by the facts. Mexico recently just recently went with a much more sane drug policy than the US has. That is only going to move more of the drug violence across the border into America because our old, antiquated and bigoted drug policies will support it.

This isn't about the government being "bad guys". (Although, this was over-kill or they went in there looking for more than 154 pot plants-of which it doesn't sound like they had reason to expect to find more. That's more man/vehicle power than went to Eddy Lepps home a few years back.) This is about defined guidelines being crossed potentially. Is there a grey area some innocent people are falling into? Yes there is. But, not everyone arrested is a medicinal dispenser just because they claim to be. If this was really about helping to get this drug to those in need without being arrested then he/she should follow the rules/guidelines laid out.

More than this could lead to:
Possession of marijuana with intent to sell is a felony, regardless of the amount. See Health and Safety Code 11359. Even if no sales transactions are observed, prosecutors often charge possession for sales based on circumstantial evidence such when the police find any of the following:
*Growing/Dispensing without a license/permit to do so
*Large quantities of marijuana
*Large quantities of cash
*Marijuana packaged in multiple baggies or bindles
*Scales
*Lack of pipes, papers or bongs
*The person arrested doesn't appear high

By the way, I do not believe these men are guilty. But,if you don't want to be called a duck then don't walk, talk & quack like one.

Except when it comes to this issue. Mexico has a better drug policy than we do? So many things wrong with that statement that its hard to even begin to rebut. Maybe we should follow their leed. Lets send all of our drug dealers to Canada. You are correct that I am letting my kid down, that is just being who I am. She doesn't lack in the education department however. Despite all efforts by our district and the State of California, My wife and I have done our best to give her as good an education as possible.

The dumbing down of America is exactly my point! Are you claiming that weed makes you smart? Do you really not know the disasterous affects that marijuana has on a childs learning capabilities. Actual defects in a childs brain caused by pot use. People are giving kids this drug and telling them it is harmless. And as long as that is happening I will support every last dollar that they spend on fighting it!

When you get these people to start being responsible with their drug. Stop giving it to kids. Stop lying about its dangers. Stop laughing at me because they make more in a month than I do in three years with nowhere near the effort. When you can tell me that they are ready to have the same regulations as tobacco and alcohol and be willing to support their own enforcement. When these things happen I will be on board for legalization. Until then I will concider all growers as guilty of a crime and I don't think I am alone with those feelings.

If you were really concerned about children and drugs you'd be watching what is being given LEGALLY to children in schools to modify their behavior. That is the gateway where kids learn that drugs can alter their minds and many end up taking whatever new prescriptions the drug companies are pushing on them this year. That is the start of their REAL addictions.

The argument to legalize/support use marijuana because it does not have overdose deaths is asinine. Should we outlaw food since far too many die every day from food related issues? I was in a beauty parlor a couple months ago and listened to two young women talk about one of them being a"pothead" and "idiot" (as the other called her), and the "pothead's" argument was "it's harmless, it doesn't really do anything. I mean I can drive fine and think normal and everything. People are so ignorant about pot." This discussion went back and forth until I couldn't resist any longer. I asked the "pothead": If it doesn't really do anything why not buy something legal like cigarettes then? Her brilliant response: "as if". I understand the benefits of medicinal marijuana - I lost a daughter to brain cancer after a ten year battle. But to say it's harmless or being used the way the law intended is also asinine and i support the law enforcement agencies in their efforts to make this place safer from crime related to this and other drugs.

distributing cannabis to minors? I don't know how that all works but my children got no treatment from a doctor without my permission until they turned 18. May there be cases where someone under 18 could use cannabis - well as far as I've read cancer doesn't check I.D.'s. Now if you know of parents that sign off on their kids getting pot on some bogus reason I'll have to take your word on it. I personally haven't seen it and would certainly questions the parenting abilities in that hypothetical family. And it's pretty easy to find out what Mexico has decided to do with small amounts for personal use. They've been smart enough to realize you can't lock everybody up. We're getting there in CA now with the early release of many prisoners that probably could have been better served by drug courts, treatment and supervision in lieu of lock-up. Instead they've spent the last period of time getting a higher education on how to commit crimes at a very high price per person per year. Our current policy has failed. I no longer care to abide the failure or to fund it.

You are assuming that these clubs are following the rules. Thats as bad as assuming the gub'ment has our best interests at heart. There is neutral ground here. I never said I don't know the potential marijuana has as a medicinal supplement. I know people whose chemo could have gone much worse without it. I also know that they still use it even though they are done. Some would call that addiction. I also know people who use recreationally. I do not look down on them as I think we all have our vices. I have even said it should be legal for them to use. The fact is, We already made all these mistakes with alcohol and tobacco. The laws are there. All we have to do is get everybody together on this. But, as long as advocates continue to lie and cheat their way through this I will continue to oppose knowing full well that eventually it will be legal. We actually agree more than you think but I refuse take this lightly with what history has proven. Even if its my history, or as Skip says "my kind" whatever that means.

so the laws I'm most concerned with are the ones I can have some sort of vote on and directly impact my community. Although I do realise the laws outside my community and state have an impact on all of us. There have been some pretty horrendous drug crimes going on in Mexico for a while now. Sandy it is because of the horrific violence that follows the cartels that Mexico is trying a different approach, they just decided this in the last week. Will it work - time will tell. Only thing I am certain of right now is that what we are doing does not work. I'm sure you and Cale don't need me to repeat the definition of insanity.

No matter how ya slice it with no disrespect to either pros or cons of the med marijuana thing the real issue at hand is over zealousness of government officials all be it federal or local. Our gov't that every one so much screams about just voting this person in or out, it doesn't make a damn!!! They are all just pawns and puppets. The bottom dollar is this... if you or I are not part of the "Just Us" system (i.e.Law enforcement of some sort) them we are in danger. Danger of false prosecutions, false arrests, and false officials. Any one who thought that they were going to see big changes with Obama is high on pot themselves and that goes to show ya it does have serious effects on the brain Lol! He is the biggest puppet of all the presidents we've ever had, EXSPECIALLY because he is black (or multiracial) how ever ya want to put it. He has not gotten our troops out of the war as promised in fact he put more in. He will not tell the DEA to cool it because all the money OUR Gov't makes on the drugs that THEY see to it infiltrate our country pay his salary and for the war (not the one on drugs either)so they tell him where to get off. The only way to end this is to do what the constitution says to do. If we dont like our elected officials then vote them out (which doesnt work) or assasinate them. That's in the constitution folks written in there by Franklin I believe. Since we can't do that the only other way to rid the gov't of their tyrany is do like other countries have done make the govt spend money on treating the druggies like Amsterdam does. They have no crime or drug problems because they dont make drugs a crime or a problem. The problem is the one way street syndrome, "Do as we say not as we do". Watch the Matrix it's Sci Fi but it's pretty damn close to what's crackin in the good ol U.S

As long as it is against the law, the law should be enforced. If you don't like the law put your time and energy into changing it. Until then it doesn't make much sense to spin your heads around over something like this.

that dispenses what a doctor has ordered that has an MD on premises. Sorry guest, but it is lawful under Prop 215 and recently upheld by the State Supreme Court. Pending legislation in the House of Representative to tell the DEA to respect States Rights. Can't wait to see the pubbies twist themselves into a pretzel over this one. Nothing about growing 154 pot plants in your yard is covered under prop 215 if you get caught making a deal to sell some of it to someone that does not have a medical Marijuana card. And, there are guidelines on how & how much you can grow for someone else. If you break the rules - the bad guys(law) come knocking (most of the time). First of all to those who say we should change the laws, that's exactly what we are trying to do at the Board of Supervisors meetings. Unfortunately, the invisible hand of the DEA continues to prevent us from making any changes for the better, as each proposal includes more ways to criminalize cannabis, rather than focusing on providing safe access as mandated by Prop 215.

As far as having over 100 plants, that is ALLOWED since caretakers can grow for others. This is the BIG bone of contention with the Feds since they will go after any grow bigger than 100 plants.

That is what Eddy Lepp was doing, growing for hundreds of other medical patients. Contrary to the lies the LEOs told in court. Eddy was RAILROADED! His trial was fixed from the start. This is what we can expect in the future if we don't force a change now.

The elections are coming and ANYONE opposing the letter and spirit of Prop 215 and attempting to undermine our rights should be voted out of office.

This is not about anybody disagreeing that someone can or can't grow (as a caregiver) 154 or so plants. You break the rules when you don't stick to certain guidelines like: HS 11362.765
2) A designated primary caregiver who transports,processes, administers, delivers, or gives away marijuana for medical purposes,in amounts not exceeding those established in subdivision (a) of
Section 11362.77 which states-
A qualified patient or primary caregiver may possess no more than eight ounces of dried marijuana per qualified patient.
In addition, a qualified patient or primary caregiver may also
maintain no more than six mature or 12 immature marijuana plants per qualified patient.
Seems the only disputable issues here are- did the defendants have qualified individuals they were growing for and/or did they make a deal that does not qualify as an allowed transaction. Nothing else is an issue legally in this case to me.
