LAKEPORT – A man convicted of molesting a 10-year-old boy was sentenced to state prison on Friday.

Senior Deputy District Attorney John R. DeChaine reported that Judge Richard Martin sentenced Lakeport resident James Michael Deback, 45, to the upper term of eight years in prison for child molestation.

DeChaine said the investigation began in March, when a neighbor witnessed what was believed to be inappropriate conduct between Deback and the child.

Jail records show that Deback, a painter, was arrested on March 28.

Formal charges were filed by the Lake County District Attorney’s Office on April 2, according to DeChaine, who prosecuted the case.

On Nov. 2 Deback pleaded no contest to one felony count of committing a lewd or lascivious act with a child under the age of 14 and one misdemeanor count of annoying or molesting a minor, DeChaine reported.

Both crimes, said DeChaine, require Deback to register as a sex offender for the remainder of his life.  

When Deback entered his no contest pleas on Nov. 2, he admitted a special allegation that the felony charge involved “substantial sexual conduct,” according to DeChaine.

DeChaine noted that the admission of this special allegation served to prohibit Deback from being granted probation, thereby ensuring a prison commitment.  

DeChaine said the case was investigated by a team of officers, including Mark Hommer and Jim Bell of the Lakeport Police Department and Investigator Von Morshed of the Lake County District Attorney’s Office.

Both Bell and Morshed have specialized training in conducting child forensic interviews in cases involving child sexual assault, DeChaine added.
 
Morshed and the victim’s family members were in attendance when Deback was sentenced, DeChaine said.

The family prepared a victim impact statement which was read by Denise Johnson of the Victim-Witness Division of the District Attorney’s Office prior to Judge Martin handing down the sentence, according to DeChaine.  

DeChaine said the felony county for which Deback was convicted is a violent strike in California, meaning Deback will not be eligible for parole until he serves at least 85 percent of his prison commitment.

I never understand these deals, a guy 45 years old with a clean record does something that will put him behind bars until he's an old man and will forever mark him as a perv-why? Chemical and physical castration has been shown to only be partlialy effective, I think the scientific community needs to do a lot more work to find ways to reduce this weird, self-destructive behaviour. Maybe until then these people should be sent to a camp of some sort where they aren't in contact with childern, because we are unable to control their behaviour by other means but can't just keep them in prison forever. I feel sad for the victim who will carry the burden of those horrible thoughts for the rest of their life, and I also feel sad for this guy who lost everything good in his life because of this form of mental illness he's suffering from.

his first offense, probably only his first bust. I figure its got to be some type of learned behavior for the most part with an occasional perv whos' brain is short circuited. 8 years is not enough and mandating he must serve at least 85% before being paroled is like assaulting the general public. His victim gets "life", full of gawd awful memories. Hopefully he didn't pass this abhorent behavior to his victim. Just put pervs into the general population at the prison, the problem may provide its own solution. Kudos to the prosecutor and Judge who I wish had a bigger book to throw at this (fill in the blank).

that this Jon DecChaine is always sending in press releases of his sentences and plea bargains?

If you wanted a bigger book to throw at these fellows, you take them to trial and get them convicted on every single thing they are charged with.

This fellow likes to see his name in print and that much is clear. Is justice being sought? Clearly not. Poor victim.

bargain? Used to be you had to plead guilty, not just 'no contest' for that. If these types of cases are being pleaded out then out District Attorneys office has neither shame or valor. And I'd need to be convinced it doesn't amount to aiding and abetting the pervie if these things are being pleaded out.Please calcuby, say it ain't so.

would this fellow enter a plea otherwise? For sure something was dismissed in exchange. Maybe the attorneys out there can clear this up. Maybe Jon NoShame can answer us. As for no shame, we have seen abundant proof of that over the past year!
