Supervisors deny Sierra Club's appeal of Cristallago EIR certification PDF Print E-mail

LAKEPORT – The Board of Supervisors on Tuesday voted to support the final environmental impact report (EIR) for the Cristallago resort and housing development in north Lakeport.


In the 4-1 vote – with Supervisor Denise Rushing being the lone dissenter – the board denied the Sierra Club Lake Group's appeal of the Lake County Planning Commission's October decision to certify the final program EIR.


Still ahead is a board decision on the project itself. With the EIR appeal now settled, the project discussion comes next, and is set for 1:30 p.m. March 2.


The project proposal would include up to 650 homes, 325 resorts units, an 18-hole golf course, spa, commercial development, equestrian facility, parks and more on 860 acres along Hill Road in the north Lakeport area.


The board had first taken up the discussion at its Jan. 26 meeting, and at Rushing's request had put off deliberations and a decision in order for her to look more closely at the project's weighty environmental document – which is several hundred pages in size – in light of testimony given at the hearing.


She also wanted to look at how the document measured up to the requirements of the California Environmental Quality Act (CEQA), and it was her opinion that the document in its current form didn't take up all the considerations that it should.


At the start of the discussion, Board Chair Anthony Farrington asked County Counsel Anita Grant if the board would create legal entitlements for the project if it certified the EIR. She said no.


In addition, she said the board could determine that no further environmental studies be done on the project's future phases, or that an initial environmental study be completed at every phase.


“So the certification isn't implying approval at any stretch of the imagination?” Farrington asked.


Grant said it does open the door to the project, which can't move forward without the EIR certification.


Rushing, who thanked fellow board members for the extra time, said she had three areas of concern that she thought were important to address.


They included what constituted an adequate EIR, what it would take to make the program EIR adequate for decision making and what obligation the board was making or implying by approving the EIR.


On the document's adequacy, she said the answers she received from Grant and from a CEQA attorney who works with the Local Area Formation Commission (LAFCO) led her to conclude that a program EIR like that one done for Cristallago is meant to lead to a “go or no go” decision.


While there may be “other bites at the apple” with subsequent EIRs, this is the best opportunity to look at cumulative impacts, Rushing said. By the time future EIRs are done, the project will have too much momentum for modifications to occur, and Rushing felt all potential issues needed to be identified now.


Second, Rushing looked at what it would take to make the document adequate.


“It looks to me like this is a very, very large project with multiple phases, and not all of the phases are clearly understood,” she said.


She said there are important mitigations and analysis that shouldn't be deferred, and she said she had crafted a list of “go or no go” decisions, the biggest among them being whether or not there is enough water in a drought year to support the project.


Rushing also argued that there was too much oak woodland loss with the proposed plan, and that the 3-1 replanting ratio is the minimum, and more should be required.


The third concern related to the area's serpentine soils, and Rushing questioned if asbestos mitigation was even possible, as all of the grading can't be done at once.


She also raised issues about the project hooking into the Full Circle Project, which takes treated wastewater to The Geysers, and road impact fees. Rushing said there were some areas that could wait, including a concern about the number of rattlesnakes in the area.


She questioned the document's claim that air quality impacts were “less than significant.”


“I don't think this one's ready,” she said of the EIR.


However, Rushing said there were improvements to the document that, if made, could make it so she would vote for it.


Supervisor Jeff Smith also queried staff about whether the EIR commits the board to a course of action. Community Development Director Rick Coel said it's staff's understanding that it does not.


Farrington asked if the county can add on requirements like solar power. Coel said any policies the board sets would be applied to future development phases. Farrington suggested they should have a future discussion focused solely on the solar issue.


Rushing said Farrington had good questions about obligations. “While this does not legally bind us, it's not meant to allow us to defer the hard choices that would result in the go or no go decision,” she said.


In addition to wanting more information on water, oak woodland loss, greenhouse gases and asbestos mitigation, Rushing said they needed to remove all reference to an economic analysis that she believed was based on faulty assumptions. That analysis, staff said, was done by a consultant, not the developer.


Farrington asked Grant about beefing up language regarding serpentine soils, which he said are common in Lake County. He said the soils pose “a legitimate concern,” but shouldn't be used to raise fear among citizens. Farrington said he didn't see the soils as shutting down development in the county.


Looking at the March 2 hearing, Farrington said he expected to allow as much latitude as possible in that discussion, which will take up everything from politics to phasing to soils – and they may even need to send out a rattlesnake counter. He said there is going to be “much, much more” work to be done.


Planner Emily Minton said the greenhouse gas requirements include solar power generation equipment on community and commercial buildings to keep the greenhouse gas amounts low. If that is not required, they'll need to include other options.


Supervisor Jim Comstock moved to deny the Sierra Club's appeal and uphold the EIR's certification, which the board approved 4-1.

for some leadership on the board. And I don't mean Jim Comstock's move to deny. That seems to be his only input in this entire lengthy discussion. So glad he's up there working hard to do the people's business. We need more supervisors with thoughtful opinions and the courage to voice them.

Victoria Brandon of the Sierra Club Lake Group encouraged the board and public to sign petitions to put an initiative on the ballot that would create a permanent funding source for state parks by adding $18 charges to personal vehicle licenses.

seem to follow the points made here by the Sierra Club supporters.

Are you serious? The progressive movement wants to take more money away from the poor seniors and workers in Lake county with a Vehicle tax? I thought progressives were for the poor and working class. Why do they want to cause even more financial hardship for people?

Why cant they just reach in their own pockets and write a check rather than to take from other peoples refrigerators and prescriptions.

They are calling it The “California State Parks and Wildlife Conservation Trust Fund Act of 2010”

They want to eliminate the pay as you use aspect of our park system and change it to you pay for it no matter if you use it or not. People who use the park after this tax is added would no longer have to pay to use the park.

Lake County should be grateful for having such thoughtful and caring leaders as Rushing and Brandon. They asked the hard questions about what is best for all of Lake County. Their concerns are legitimate; their concerns, by a far measure, have not been addressed by this 4-1 BOS decision to forgo an EIR at this stage of deliberation.
Comstock took a deliberation-cue from Supreme Court Justice "Silent" Thomas, who sat silently throughout most of the deliberations, then voted for the awful decision to give corporations the right to buy elections.
It would be interesting for Comstosck, et al, to put forward their rational for not demanding a full EIR to address all the obvious, and stated, environmental concerns with this mega-project.

I don't make use of. I pay for a prison system that I don't visit either. No use of parole or probation officers either. Ditto for Juvie. And on and on.

Been many years since I made use of the parks systems and doubt they are in my future - but I sure want to see the grandkid enjoy them with his parents, as I did with them years ago. Besides - we need a place for all the homeless folks there will be when it all goes to hell here pretty soon.

Cristallago is stupid squared - pop the corn honey, let's find out if 'stupid is as stupid does' is really true.

were rescinded, we would be able to fund parks and education. If small increases in the tax percentages for the wealthy were implemented, a huge amount of our suffering could be eliminated. It's funny how this has fallen out of the state wide discussion. I sure don't blame Victoria for being realistic about the futility of seeing any progressive tax solution. We should none the less be demanding that the rich chip in on the problems they created.

Instead the BOS seems to be headed toward having us subsidize a rich man's game - in this case Cristillago - where we will pay for the rest of our lives to provide a higher level of services for a golf community, then we enjoy ourselves. All so some wealthy developers can make a bundle.

It will be interesting to see how many supervisors represent the developers, and how many represent the people of Lake County. Thank you Denise Rushing for representing our interests.

I didn't single out a "black man", I singled out "Silent" Thomas since he is like the "Silent" Comstock. Don't play the race card where it doesn't apply.

As to the reference to corporations now being unleashed to dump as much money as they want to get "their" people elected: this is wrong, as you should know, and is the result of a long ago clerical error that gave corporations the rights of real people. I will certainly vote for a Constitutional amendment to right this awful wrong. And yes, the media corporations, owned by conglomerate corporations, cherry-pick the news to suit their owners views and fiscal needs.

I am grateful for independent press, like Lakeconews.com, and for other non-corporate news sites, where I can get REAL news, not clever self-serving spin..

By the way, you didn't address my main theme which was: why the four didn't vote now to clear up the 27 problems with the EIR, and get it out of the way.

Shame on you, Jim Comstock. You seem to have one agenda and one agenda only, which is to approve development, regardless of its' feasiblity and true value to the community.
Thank God that we have at least one intelligent, informed supervisor in the person of Denise Rushing on the BOD.

Let's just see how dumb Comstock really is.....
Unemployment in the County is over 20%, highest in its history and Konocti just lost 630 jobs and what on earth does Comstock do.... supports Cristallago, that will provide 670 jobs... he acts like he cares about the County. How could he do that doesn't he know the project is visible from Hwy 29 for "my god" 20 seconds, you mean 20 minutes no 20 seconds. How on earth could anyone, including Comstock, support a project that would bring 670 real jobs, not "Obama"( now if a person gets a promotion or pay raise it counts as a job) jobs, 40,000 visitors, $800,000 Transit tax for the County, $51M in taxable sales, and has analyzed the projects feasibility because golf is a dying sport. But it is also supported by 975 upscale residential and hotel units.

But the really "smart" VFW (Victoria Following Winers) support the Guenoc Golf project , which has no supporting facilities, yet it will survive? Now, for all the VFW group, we have some "oceanfront property in Az".......
Oh yes, I remember now the Guenoc golf is there to support the troubled wine sales. Now wouldn't you think for one minute that Comstock member of the school board would realize that in math two negatives make a positive and wouldn't that apply to business as well?? For those of you from Rio Linda, that means a business "like the winery in Guenoc is failing so we will then support it with another, according to Miss Victoria, dying business such as golf..........

If Comstock is dumb. What on earth would you call the VFW (Victoria Following Winers)?????

The Sierra Club stands up for me and what I believe is in the best interests of the community. I am not even a member, but if not for the volunteers of the Sierra Club and other such organizations, I would have little or no clout when it comes to madness like Lowe's, Cristallago, Provensalia and a host of other greed based projects that I believe a clearly the opposite of "progress."
The for-profit corporations are well represented, well funded and subsidized by the tax payers.
Those of us who would like local development to be well thought out, carefully planned and tailored to be good for the people that live and do business here are grateful that there are these groups. Even those who don't agree with them should be glad they are here to provide some balance.
As for "volunteering" to support parks and other community endeavors, it is how some of us define our lives.

why someone would fall for the promises of some developers who, after getting state tax breaks for their income level that cause us to see lots of layoffs, then come to our county and say; "don't bother making a general plan. We will plan your county for you. We will employ a few of you (but mostly out of county people, or people who were already working) and then we will take the profits and bribe ourselves some more tax breaks, or grease the wheels in some other county".


We came up with a general plan to avoid the huge cost to us of supporting such unsustainable games that developers play with our lives, but it leaves the mystaery as to why people would fall all over themselves in their eagerness to finance such arrogant disdain for our attempts to govern ourselves.

Your feeling that we are utterly incapable of planning our own destiny, is sadly a self fulfilling prophecy.

The same big corp guys that own the Guenoc golf course project and got sued in Hawaii for.... must really be a proud day for the 350 members of the Sierra or the VFW.

GP -preserve ag land hundreds of acres none designated in the GP
for the golf course

Urban sprawl average miles to services 2.5 miles to same services
7-25 miles

Carbon-foot print over a GP lifetime after buildout
340% more, or 250,000,000 #'s
of CO2, than Cristallago.

Actual cost of travel Lake County has very low-income folks,
and thanks to the SC for supporting Langtry
a big-time corporation, the additional cost
to them is over $40,000,000 just to get the
services that the Cristallago has access too.

If you have facts that refute those facts please provide... you and the SC's generalities accomplish nothing......

I don't support any Guenoc project, and why would it make Cristallago a go, even if I did? Why if there is something worse (or perhaps not, I don't know) should we support something we know is bad for the county?

I had a chart prepared, but the computer apparently didn't like the layout and reformatted it when I entered it. "must be one of them"

Background, the image of the County was lousy according to those in power about a decade ago and they retained the top real estate and economic consultants in the US. Recommendation from the smartest folks in the country. 1. must have an upscale destination resort, signature golf course, upscale residential, must be a large site, have an extraordinary amenity package and this is very important SHOULD BE LOCATED AT THE NORTH END OF THE LAKE, not out in the boondocks. Now that has been the policy direction of the Board for 7-8 year, if you or your group did not like that policy, then you should have commented or recommended changes to that policy direction. 7-8 yrs. I would not consider that rushing into............. After all this project has been the most open and transparent project in the history of the County. 5 years, 9 public hearings. Not sure of your political party, but open and transparent is an oxymoron to the one in power now
Now Cristallago has all of those elements, so it is as much the County's project as it is ... the developers....wouldn't you think???

With that as background, specifically, what is wrong with the project??
