Taylor: TV8 subverted by local control PDF Print E-mail

In my opinion, the recent actions of the city of Clearlake, locking out operational personnel from the TV8 PEG station located within city hall, preventing public access, was a violation PEG station governing law, and constitutionally granted freedom of speech.


Recent restrictive actions by the TV8 Board, primarily by Jeff Smith, Joyce Overton and Ed Robey, began in earnest when the TV8 Board met at their Dec. 9 meeting where an apparent attempt to restrict nonlocal programming with a new policy was created.


The objection to these videos by the board was apparently voiced as too “far out” (related to “conspiracy theory“), and that county supervisors would not support this kind of programming.


In addition, they claimed some few unknown persons (as opposed to the many TV8 viewers who enjoyed being informed by such videos) objected to this kind of programming using this excuse as a further basis to impose the new “provisional” policy (while publicly claiming at a later meeting the need for more local input as the reason for forcing a change in TV8 programming).


However, the TV8 board was created as advisory board, and not to act as a policy implementing board. By creating and dictating a programming policy it changed its functional nature, which is why Shawn Swatosh (from Mediacom), a TV8 Board member, resigned due to potential legal issues against Mediacom that can result from such a board dictating programming to a PEG station.


This action by the TV8 Board also makes the county and city (Jeff Smith is a Lake County supervisor, and Joyce Overton, an elected Clearlake City official) potentially liable for such restrictions of free speech, regarding the operation of a PEG station.


Apparently, subsequent actions by the then-acting voluntary TV8 PEG station manger Allen Markowski were deemed inappropriate and contrary to TV8 Board and city powers of control (the city is the franchise owner of the PEG station), and City Administrator Dale Neiman locked out all public access to the station. The city, in some unmentioned conjunction with the TV8 Board members, apparently accomplished this lockout action without regard or discussion with the TV8 Advisory Committee and without civil due process.


Following the closure of the TV8 station to community public access, the TV8 Board, at Clearlake City Hall, held public meetings on Jan. 13 and Jan. 20. Various objections to the board’s action and their rationalizations aired but at the Jan. 20 meeting, it was clear the TV8 Board was to assume complete control, which basically includes a dictatorship of programming over the “public” part of the Public, Education, and Government aspects of operation of a PEG station.


Coming from a fuzzy advisory position, the TV8 Board now assumed more complete control by essentially firing the voluntary provisional TV8 operation’s manager, Markowski, the most successful manger to lift TV8 out of its previous obscure and retarded position against substantial political and financial obstacles, and dissolved the TV8 Advisory Committee and all TV8 PEG station operational personnel.


It becomes obvious that a PEG station should not have politically minded county or city officials in control of its programming operations (in spite of franchise considerations), as that control is in conflict with the public access to free speech which represents the nature of a PEG station.


Political dogma and bias tend to infest and pervert the meaning of free speech when political power assumes such authority over the principles for which PEG stations exist.


The operation of the TV8 broadcast station, once created (regardless of city franchise ownership) is by and for the people of Lake County, not for the personal biases of public officials pretending to represent the People through a PEG station, and where such “government” control is legally prohibited in terms of programming.


Indeed, under “Powers and Limitations of a City” the “Limitation on Personal Activities”: “No city council member may occupy two different public offices at the same time, if the offices are incompatible one with the other.” In my opinion, Jeff Smith and Joyce Overton, as TV8 Board members, establishing and dictating programming policy, represent political positions in conflict with the TV8 PEG station operations as proscribed by both Federal, and by state law in this case.


To challenge an establishment’s identity of control becomes a threat to that establishment. Such a threat tends to translate into actions against organizations and individuals, politically (and often underhandedly). Free speech and truth suffer under these conditions, and history shows a long struggle to preserve this freedom.


The very existence of TV8 as a PEG station is one of those entities created in the attempt to preserve the value of truth and freedom against intrusion by political and corporate influence. Programming is a major concern because of this potential influence, which often results in such deterioration, but which is protected under the Constitution of this Republic, for obvious reason.


Such actions as the Clear Lake TV8 Board has recently demonstrated, in terms of policy and control, have demonstrated an attempt to subvert these constitutional guarantees with political intrusion and distortion. The recent, hastily imposed, ill formed provisional policy (a weakly disguised programming control over content), and subsequent action of locking out public access to the TV8 station, represents that malignant interference and conflict of interest, in my opinion.


Having said the above, the TV8 PEG Board at the Jan. 20 meeting apparently adopted a new station manager, Terri Larsen, who outlined at this meeting a new and comprehensive TV8 operational structure called “transition television” as a replacement of the former operational staff. This promises to implement more local programming and a revised structure for the good of the PEG station.


More power to them, but in my opinion as a former TV8 PEG Advisory Committee Member volunteer, beware of imposed political dictatorial powers acting under the guise of a TV8 PEG Board composed of elected politicians, and others who subvert free speech in covert ways.

that the actions of the TV8 Peg BOARD amount to strict censorship, thinly disguised under the hypocritical pretense of more local programing requirements, set in motion by the objections of a few unnamed but presumably influential and without a doubt narrow-minded and obtuse Lake County residents, and against the will of the majority of the viewers.
So much for community television in Lake County...Here is another routine example of what a lack of intelligence combined with a little power can accomplish.

Allan Markowski should be given a Lake County Star, or, at least, a big Thank-You from The Advisory Board, for his sincere dedication to the community-at-large, volunteer work. This man is a gift to Lake County and deserves an apology and honor.

It's amazing to me how much criticism is being poured over a group of volunteers whose only objective is to provide balanced programming to the station instead of the blitz-style programming of certain programs (known as imports) that occurred for months. The PEG Board has not BANNED any of those imports but rather are programming them into appropriate time slots and emphasizing the policy of promoting locally produced programs over imports. What's wrong with that? The goal of the channel is to encourage all citizens of Lake County to get out there and create their own programs to be shown on the channel and let their voice be heard. The way the schedule was before local programming got stuck in the back seat never to be played on the channel ... that's why the PEG Board stepped in and changed things, it's their job as guardians of the channel to do so.

What also amazing to me is how people sit back, whine and criticize rather than volunteer to change things at the station. There is now a group of dedicated volunteers doing that exactly that and the question is WHERE WERE YOU when the call for help went out? Criticizing instead of bringing forth change.

I think Jeff and Joyce didn't want to hear any gripes about a bunch of commies running TV 8 while on the campaign trail, so they made a pre-emptive strike on the station. Of course Allen and Dante didn't help themselves with their reaction (running the scroller with the PEG board members contact info), plus they WAY over-played the "censorship" card (kind of like this one-sided and misleading letter).
There are times to stand up for free speech but endless re-runs of a crumby pot video and whack-job 911 conspiracies are NOT worth the trouble, they should have been able to work-out a compromise but choose the bedwetting/sky-is-falling route instead. TV8 belongs to everybody, not just lefties, when other voices complain about programming they need to respect their opinions too.

who gets custody of PEGTV8? Just curious - I be loving me my Direct TV. You can actually see the lower numbered channels instead of viewing what appears to be a whiteout in Montana in January.

Is Aaron Russo a "lefty"?
Was the video about the undeveloped oil reserves in Alaska a "progressive" video?
Were the citizens of Lake County beating the TV8 doors down to air their own "home grown" videos?

The only problem was a repetition of the exact same videos over a period of many months and consequently a lack of variety, not the political content, which was balanced (by the way, an independent, non-governmental investigation of 9/11 is not necessarily a "whack-job conspiracy theory", it only opens the door to questions which should not be dismissed off-hand unless irrefutably answered).

So we went from one extreme to another, from airing the same videos over and over every day for a long period of time to showing any given video once.

It seems the board went from complete apathy to hysteria.

indeed, it stepped in like a 500 pounds gorilla...and now it asks where the people were to help...To help what exactly? The board created the crisis, and essentially killed TV8.
The Board is forcefully attempting to promote more local programing...good luck with that!
Apart from pot and red neck politics, there won't be much happening on this station.

There is a group of volunteers dedicating themselves to redeveloping the channel which would go further and faster except for the sabotage that has been occurring. Whom ever is participating in this petulant and childish behavior should realize that progress continues regardless of their actions. Many of the statements you've made are false and out and out lies. By perpetuating these rumors you are only showing your unwillingness to open your mind to what really went on. As I said before GET OVER IT and move onto more constructive activities. How about volunteering to bring the channel to new heights of professionalism?

A lie implies a knowledge of the truth and a conscious effort to distort it. If my opinions regarding the past and current processes at the station are proven wrong, that's really good news for Lake County, and I will be the first to apologize. Then the board can come to term with how it presented what it perceived to be problems at TV8 partly as a political (conservative versus liberal) issue, which obviously made many people very suspicious of its actual motivations and objectivity.
So my reaction was strictly motivated by this political aspect of the board's objections, nothing more.
We all get very tired of politics, and of the efforts of one side of the political spectrum or the other to attempt to suppress the free expression of ideas.
I am "over it", and although it would be nice to see TV8 succeed, it is not a major issue, and my opinion, whether critical or supportive, is really not important at all, and should not be, since I am not part of the process.

The PEG Board BANNED, that is, restricted or censored imports from prime-time broadcasting, and extended prime time hours WHEN THERE WAS LITTLE LOCAL PROGRAMMING AVAILABLE, RESULTING IN BLANK TV SCREENS. This was a direct result of the Board’s ignorant and illegal violation of free speech as well as PEG, State, and Federal law (Shawn Swatoch, representing Mediacom, resigned from the TV8 Board because of the possible ILLEGAL actions of the Board regarding its programming attempt).

To create more local programming is to generate more local interest and volunteers, not restrict videos that were generating that interest. This was an inept political gang (Ed Robey, Joyce Overton, Jeff Smith) that failed to reasonably communicate and attempted to promote what they thought Lake County should see, politically, and was not a matter of generating more local programming, but rather destroying TV8, which is supposed to be open to all points of view, not what the Board or Terry Larson says you should see or not see. The issue is bad government, and political corruption by a City that has created a hoax upon the citizendry called the TV8 Board of directors. Terry Larson apparently supports this hoax, possibly in ignorance of the facts. This lackey manager, spreads the Board’s dogma with lies, and inaccurate statements. It is the ineptness of how to run the station and not a claimed sabotage by which she whines and dances.

Alan, the previous provisional manager of TV8 was in the process of developing more local input, and had gathered a number of volunteers to that end, but the City of Clearlake has no real interest in Public Access (proven by the many years such was not utilized), and just as the City fought live broadcasting, Dale Neiman shut it down before. And this second time of lockout was again a function of covert suggestion by the Board, the manager being the fall guy or scapegoat. This is a corrupt City government where now they have found their puppet to promote their dictatorship over the People of Lake County.

This country is coming under economic fascist rule via government and corporate perversion of the Constitution and other means while ignorant local politicians and citizens play as their freedoms constrict, all legal like, and while ignorant people like smurf and motherwestwin tip toe through the tulips mouthing “get over it,” and inane allusions to “commies” or “lefties.” These people apparently don’t have a clue, like the TV8 Board, not recognizing their censorship programming, even after one of their members quit. Disgusting.
