Animal control is out of control! Shades of Gary Lockhart, perhaps Denise should look for a job in Trinity County as well.
Director Denise Johnson has refused repeated requests to enforce California law SB 1578, which prohibits tethering a canine to a fixed object for more than three hours. Despite several written complaints concerning tethered dogs and barking, the response has been “they have food and water and are OK, nothing we can do”. This is nothing short of dereliction of duty as a public official and can not be tolerated.
SB1578” (d) A person who violates this chapter is guilty of an infraction or a misdemeanor. (1) An infraction under this chapter is punishable upon conviction by a fine of up to two hundred fifty dollars ($250) as to each dog with respect to which a violation occurs. (2) A misdemeanor under this chapter is punishable upon conviction by a fine of up to one thousand dollars ($1,000) as to each dog with respect to which a violation occurs, or imprisonment in a county jail for not more than six months, or both. 92 Ch. 489 — 2 —“
Johnson should be fined several thousands of dollars for allowing this to go on, along with her staff. It seems that one paragraph of the law may be the loophole.
“(4) “Reasonable period” means a period of time not to exceed three hours in a 24-hour period, or a time that is otherwise approved by animal control.”
Or a time that is otherwise approved? So if we don’t want to enforce it we will allow 24/7 tethering of dogs? Sounds convenient to me as well as the “staff shortages”, “Vacations” and “maternity leave” often quoted during our phone conversations as to why they can not or will not respond to a call. Add that to the 2 + Million dollar dog pound under construction and I have to wonder why they can not or will not do their appointed function.
I am awakened at the first light every morning by barking dogs tethered in their yards; I have filed numerous written complaints with little or no effect. I am always promised that an animal control officer will investigate. Including ridiculous claims that they will come in the middle of the night to “listen” for barking dogs, hogwash!
My letter to the Governor: I am concerned that our director of animal control here in Lake County is not performing her duties in regard to SB 1578. Specifically not enforcing the law I have made several complaints for tethering and barking due to neighbors having dogs chained in their yards 24/7 the response is always the dog has access to food and water so no problem. It is a problem when you watch one of these animals that runs the 30 of so feet of it’s chain back and forth all day. The owner of this less than one year old dog only comes into the yard once or twice a day to feed and water the animal, even they must realize what is going on as they have put plywood leaning up against the siding of the house to prevent the dog scratching the siding as it runs to the extent of it’s reach and jumps against the walls for hours at a time. This is sick and Director Denise Johnson has refused repeated requests to enforce California law SB 1578. I have had enough and hope your office can provide some help.
