This was an unfortunate accident. The speedboat was clearly irresponsible, traveling at a high rate of speed in almost total darkness (what was he thinking? was he drunk?). If the running lights on the sailboat were not on, then the operator bears much responsibility. Both parties were at fault, then. If they can\'t find reason to put more scrutiny on the unsafe actions of the speedboat, they should stop prosecuting the current scapegoat and call the whole thing a very very unfortunate accident.
